In the recent case of National Spot Exchange Limited V Dr. Anil Kohli1, the Hon’ble Supreme Court (“SC”) upheld the decision of the Hon’ble National Company Law Appellate Tribunal (“NCLAT”) refusing to condone the delay of 44 days as it was beyond the total period of limitation of 45 days prescribed under Section 61(2) of the Insolvency & Bankruptcy Code, 2016 (“IBC”).
